ECS Maintenance Scheme 

  
All ECHO computers come with a standard return-to-base 1 year hardware warranty. We 
offer annual on-site maintenance for all new ECHO computer systems within our area. All
customers in this scheme will have repairs carried out at their registered address by our
technicians. We will ensure that all repairs are carried out to the same high specification as
the original ECHO PC. Replacements will be provided if an item is deemed beyond
economical repair. Please note that this cover is for PC hardware only. Printers,
scanners, cameras etc, and software problems are not covered in this scheme.
 
If you experience problems, you should telephone or email (see support form) ECS and we
will arrange a visit to correct the fault. We will make every effort to recover data from
defective hard drives, but cannot give any warranty as to the success of such operations.
To upgrade our standard warranty to on-site for the first year is £26 plus VAT. For second
and subsequent years the charge is £52 plus VAT per PC. Servers are individually priced,
depending on hardware fitted. For customers with multiple PCs, we will offer a percentage
charge to make renewal dates the same. Only components fitted by ECS are covered. 
 

ECS Maintenance Conditions

 
1. PERIOD OF AGREEMENT
Except as otherwise provided in these conditions, this Agreement shall remain in force
until terminated by either party. Notice of termination may be given of the entire
Agreement or in respect of any item(s) of the equipment.
2. THE MAINTENANCE SERVICE
 
2.1 The Maintenance Service compromises remedial maintenance visits during working
hours of 9am to 5pm Monday to Friday (public holidays are exempt) as requested by
the Customer.
2.2 In providing the Maintenance Service ECS will use reasonable endeavour to
maintain the Equipment in good operating condition in accordance with manufacturers
specification and recommendations.
2.3 ECS will provide as part of the Maintenance Service all necessary replacements for
worn or defective parts excluding consumable items. Any parts removed will be the
property of ECS.
2.4 ECS will endeavour to attend within 8 working hours but no guarantee is given that
this response will be available at all times.
3. CUSTOMER RESPONSIBILITIES
 
3.1 The customer shall ensure that the equipment is kept and used only by competent
personnel in a normal and proper manner and in accordance with the manufacturer and
of ECS.
 
3.2 The customer shall give ECS full and unrestricted access to inspect and maintain the
Equipment and shall provide safe and suitable working conditions at Site Address for
ECS's service engineer.
4. Exclusions
The Maintenance Service does not include the following which, if requested by the
Customer and provided by ECS, will be charged at ECS's standard rates then in force.
a) Work or materials required as a result of causes other than ordinary use including
but not limited to damage in transit or installation, any movement of the equipment
(other than ECS) accidental or deliberate damage, fire, water, unsuitable
environmental conditions, misuse, neglect, failure to comply with condition 3, the use
of unsuitable consumable items or any failure to maintain or support software
associated with the Equipment.
b) Attendance other than at the specified Site Address.
c) The maintenance or support of software other than the Equipment's operating
software.
5. CHARGES
5.1 ECS may by giving 30 days written notice expiring on any day on or after the first
anniversary of the Commencement date vary any of the charges. The revised Charges
shall become effective upon expiry of such notice unless the customer has given prior
notice terminating the Agreement from the date of variation.
5.2 If any part of the Charges have not been paid within 30 days after they become due
ECS may suspend the Maintenance Service until the amount due is paid and/or by
notice in writing terminate this Agreement forthwith without prejudice to any rights
which may have accrued to ECS prior to such termination.
5.3 The Charges are exclusive of Value Added Tax, which shall be paid with the
Charges.
6. LIABILITY
6.1 ECS will be liable to the customer for death, personal injury and direct physical
damage to property at the Site Address to the extent it is caused by the negligence of
ECS or of its employees acting in the course of ECS's business. ECS shall under no
circumstances be liable for any loss of business or profit or for any indirect or
consequential loss arising from such damage to property or for any loss to the
Customer's computer programs or to any media data or information contained on
such media even where it is caused by the negligence of ECS or its employees.
Except as expressly provided in this clause ECS shall not be under any liability
whether in contract or tort for any loss, damage or injury however caused by the
negligence of ECS or its employees.
6.2 Neither party shall be liable for any failure to perform any of its obligations under this
Agreement if such failure arises from war, strikes or other labour dispute, lock out, fore,
 riot or civil commotion, legislation, restricted availability of spare parts or any other
cause or effect beyond its reasonable control.
7. GENERAL
7.1 This Agreement sets forth the entire Agreement and understanding between the
parties as to the subject matters of this Agreement and merges all prior discussions
between them. No waiver, alteration, modification or addition to this Agreement shall
be valid unless made in writing on or after the date hereof and accepted by an
authorised signatory of ECS.
7.2 In this Agreement "an ECS service engineer" includes an engineer of an ECS
sub-contractor.
7.3 The laws of England shall govern the construction and validity of this agreement.
